1. Acceptance of Terms

By accessing or using Soaply ("the Service"), operated by Caruso Business Solutions LLC ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Soaply provides soap and cosmetics calculators, recipe management tools, supply inventory tracking, and cost analysis tools. The Service includes both free and paid (Pro) features.

3. Calculator Disclaimer

Soaply's calculators are tools to assist your formulation process. They are not a substitute for proper safety research, testing, and professional judgment.

Lye calculations are based on published saponification values, which can vary between suppliers and batches.
Always verify calculations independently before producing products, especially if selling to others.
We strongly recommend running test batches and using pH testing strips to confirm your soap is safe.
Bar property predictions (hardness, cleansing, conditioning, etc.) are estimates based on oil fatty acid profiles and may not reflect final product characteristics.
Fragrance usage rates are general guidelines. Always check individual fragrance Safety Data Sheets (SDS) for maximum usage rates.

We are not responsible for any products you make using Soaply's calculations. You assume all risk and liability for formulating, testing, and selling your products.

4. User Accounts

You must provide a valid email address to create an account.
You are responsible for maintaining the security of your account credentials.
You must not share your account with others or create multiple accounts.
We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Payments

Pro subscriptions are billed monthly ($8/month) or annually ($60/year) through Stripe.
Subscriptions auto-renew unless canceled before the next billing period.
You can cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing period.
We do not offer refunds for partial billing periods, except where required by law.
We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. Your Content

You retain ownership of all recipes, formulations, and data you create on Soaply. By using the Service:

You grant us the right to store and process your data to provide the Service.
If you share a recipe to the Community Recipe Library, you grant other users the right to view and use that recipe for personal purposes. You can remove shared recipes at any time.
We will not sell or commercially exploit your recipes or formulations.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to access other users' accounts or data
Scrape, crawl, or automate access to the Service without permission
Upload malicious content or attempt to compromise the Service
Misrepresent your identity or affiliation

8. Intellectual Property

The Soaply name, logo, design, and codebase are the property of Caruso Business Solutions LLC. Oil data, saponification values, and fatty acid profiles are derived from publicly available sources.

9. Limitation of Liability

To the maximum extent permitted by law, Caruso Business Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation:

Products made using Soaply's calculations that cause injury, property damage, or other harm
Loss of data or recipes
Business losses or lost profits
Service interruptions or downtime

Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that calculations will be error-free or that the Service will be uninterrupted.

11. Account Deletion

You can delete your account at any time through your account settings. Upon deletion, we will permanently remove your account data, saved recipes, supply inventory, and batch logs. This action cannot be undone. If you have an active subscription, please cancel it before deleting your account.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page. Continued use of the Service after changes constitutes acceptance. For material changes, we will make reasonable efforts to notify registered users via email.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts of Baldwin County, Georgia.
